Father's property

We are 4 sisters. I am unmarried and was living with my father in a flat owned by him. My father passed away and he had gifted the flat to me, and it is now in my name. I am living in the same flat and paying the maintenance etc.

I want to make a will and transfer the flat to one of my sisters whom I am closest to. But the other sisters are saying that since it was fathers property and he gave it to me just so that I can continue living there since I am unmarried, I cannot give it to one sister, it should be divided amongst all 4 sisters.

Do they have a legal right to the flat and can they contest my will and create trouble later on? How do I protect myself and make sure the flat goes to the sister I want to give it to?

The above your querry is clearly explain. Because the father has transfer the flat by way of regd will deed? what are the contents mentioned in the said will that also consider. and whether the father has transfer the flat in well condition and other legal aspects also consider.

if any one challenge the will then court after full hearing will decide the validity of will too. so by your demand that the said flat only give to one of your sister is not possible at this moments.

if any sister challenge the will then the court will decide what is the legal rights of all sisters too

Sir, There was no will, it was a gift deed.

If the property has been duly transferred to you through a registered gift deed, you are the absolute owner. The sisters have no rights or interests therein. You are fully competent to dispose of otherwise deal with the property at your discretion.

The property has been transferred to your name by your father by a registered deed henc e it becomes your own and absolute property.

As you are having clear and marketable title to the property you are well within your rights to transfer this property to anyone of your choice.

You can ver well transfer the ame to the sister of your choice and it is legally valid, the other sisters cannot object this for any reason.

Since you have became absolute owner of flat through duly registered gift deed so no one have right to claim any share in flat, you can sale, goft or bequeath the flat to anyone as per your wish.
