A cardinal question of public importance and one that is likely to arise more often than not in relation to the lodging of the First Information Report (FIR) with the aid of Section 156(3) of the Code of Criminal Procedure (for short, ‘the Code’) or otherwise independently within the ambit of Section 154 of the Code is as to whether there can be more than one charge sheet in relation to the same incident or different incidents arising from the same occurrence.  -

In law, there cannot be two charge sheet registered in relation to the same occurrence or different events or incidents two or more but forming part of the same incident. The direction to register a second charge sheet, therefore, is contrary to law and the very spirit of Section 154 of the Code.

For any FIR, there cannot be two chargesheet, but the investigating agencies can file additional chargesheet, in continuation ,during the course of investigation, when lot of events unfolds.

For any FIR there will be only one chargesheet but sometimes investigating agencies also file supplymentry chargesheet when some part of investigation left behind.
