I worked for 2 months in a small software company in Bangalore as Project Manager.
The CEO of the company on 19th Aug 2010 has send me an threatening email to solve one tricky software issue, before the end of next day i.e.20th Aug 2010, failing which he will keep me out of any company related affairs (in other words terminate me). On seeing that email on that day morning in the office, I felt deeply upset by the tone & harshness of the email content & I replied back telling that it is not possible to solve the issue in one day as it is complicated & I offered to resign from the company with immidiet effect with complete settlement of my salary for full Aug month.
He responded to me by SMS in that day evening informing me that I have been relived from the office with immidiet effect. When I enquired about my salary settlements by SMS, he replied me that I have cheated the company with false representation (false experience certificates) & company is no need to pay any salary for me even though I worked for 20 days on Aug 2010 & further he will initiate a legal action on me after he comes back to Bangalore to recover 1 and half month salary already paid to me, as per the offer letter terms & confidtions.
Later he did not do any thing & never rsponded to any of my emails. Meanwhile I send an email to owner of the company explaining my case & he assured me by return email that he will settle my salry by next month. But he kept on repliying me 2 or 3 times the same thing & nothing has happened. I met him personally & then also he assured me of my salary (appx. Rs.35,000 for 20 days work) that it will be paid in a week. But nothing has happened. Later he stopped responding to my emails.
Now What I have to do to recover my Salary due for atleast 20 days for which I have worked legally ?
I have offer letter from them (both email & paper form) but do not have any termination or relieving letter from them till now apart from the SMS send by the CEO on 20th Aug 2010. I have email replies from owne of the company.
Shall I able to get my dues back or forget it. Whom to approach in this regard,
I will be very obliged if any one answer to my problem as I am out of job still & in bad position.
