Very interesting question u asked. In my view if we refer Sakari Vasu Vs. State of UP and otrs. 2008 (2) SCC 409 then seems the complainant and Police both are at fault in some way. The complainant had the option to approach Lower Court with option U/S 156 (3) and MM would be duty bound to give instruction to PS to register FIR based on complainant petition itself.
Something is missing (Point of Law) in delay as pointed is what I feel.
