Flat registration process

Hi All,

Just wanted to understand and your guidance in the below scenario:

I have booked a flat in NOIDA under joint name of my wife and myself. Now the situation is that the builder will be handing over the possession to us and post which we are supposed to get the flat registered with NOIDA authority.

Now the problem is that there are chances that during the possession time, i may not be in india. 

Thus, would my wife be alone be able to register the flat alone or my presence is required for getting the flat registry, as the flat was booked on joint basis ?

Is there any way, as i am ok for getting the flat registered on her name instead of joint name registry.

You have two choice, either you can let her alone own the property or execute a SPA/POA in wife's favour appointing her as your duly executed agent to sign the sale deed on behalf of you thereby you would be also a co-owner of the property with your wife. Thanking you, Subash.M.R.Advocate

It is better to execute a GPA or SPA deed in favor of your wife to sign the sale deed registration on your behalf.
