I had served a Tradeamark ease & Desist Notice to a party on behalf of my client.
In addiion to normal demands of a cease and desist notice, I had demanded following in the notice:
"To forthwith furnish to our clients or to us on their behalf a written UNDERTAKING on the STAMP PAPER of Rs 100/- duly notarized as drafted by us on behalf of our clients that inter alia you shall not henceforth use the said trademark and/or the artistic works and/or or any other marks which are identical and/or deceptively similar to our client’s mark to market your goods, and that you shall not use the impugned marks/artistic works on your pamphlets/brochures/etc. or in any other manner that is deceptively/confusingly similar to our client’s said mark and/or artistic work."
Now the infrigning party is ready to stop infringement and comply and is asking us to provide a proforma of a Compliance Undertaking.
Can some friends on the Forum help me a sample Draft of such Compliance Undertaking?
