Full and final settlement ssue

Dear Experts,

I was working for a firm from Jun-16 to June-17. I have served my notice period and completed all formalities. my full and final settlement and experience letter is stuck with them and its been 4 months. i have been following up rigourously but still havent got convincing reply from HR. i am facing lots of financially issue because of it. Should i go to labour court for it, if yes then how much time effort and money it will take from my end???

You may invoke the provisions of Industrial Employment Standing Orders Act, SE act applicable to the state, Payment of Wages Act, Industrial Disputes act as per explanation of employee under these enactments or thru civil court. Yourlawyer may prefer to issue a legal notice.

Why are you asking such questions?

Your hard earned wages are not imp. to you?

 

Haven't you asked LOCALLY from jurisdictonal O/o ALC/Labor Court/CGIT?

NO noteworthy fee/expense in approaching Conciliation Officer, Labor Court. It is negligible.

Time; Ask locally and as per local rules/precedence’s how many opportunities are granted for conciliation?

While posting such queries employee should post basic information!

What is this establishment; Commercial, Industrial?

What is its nature of business say; IT, ITeS?

How many persons are employed in it?

What is your designation and nature of duties?

How many persons report to you?

Do you have any power to sanction leave/increment/appoint/terminate/appraise etc etc ?

You are in which state? Since how many months you are working? Are you under probation period or your service is confirmed in writing?

 

Do standing orders (model/certified) apply to establishment and your designation?

What is notice period as per appointment letter/offer letter and what was notice period tendered by you?

Was ever any stinker, memo, show cause notice on any misconduct issued to you?

Does the establishment have its appraisal system? Do you have copy of signed appraisal forms, matrix, KRA’s, performance date? How was your performance?

Are you a member of employee’s/trade unions?

Has the establishment issued/supplied, offer letter, appointment letter, salary slips of all months, PF number and a/c slips of all years, ESIC card, correct FnF statement, Form 16 as per correct FnF statement, acknowledgment and acceptance of notice of resignation/final resignation, acknowledgment of handover of charge, NOC/NDC……………?

u can approach labour officer personly by writing a simple complaint and also approach any magistrate through a private complaint.....

When as querist you post a query ans want infor then post response to points raised.

The unions can also support,guide and help.
