Gift registration

Sir,

My mother has done a gift registration of 6 acrs land to my sister. In those 6 acrs only 3.90 acrs are having registration on my mother's name and 1.10 acrs is not on my mother's name.

This 1.10 acrs is on some other person's name. But my mother registered total 6 acrs to my sister.

Is this registration valid?

No she can gift only the property thats on her name otherwise the transaction is illegal

No she can not gift those properties which are not in her name if she had done so then on challenge in the court the gift will turned illegal and invalid gift .

Thank you so much for your replies. I have already challenged this in the court. I am getting different opinions like it is partially valid and fully invalid.

Because, those 6 acrs are not on same survey number. But all are mentioned in same schedule in the registered document.

Is this still illegal?
