Hi All

I have a query as below and need further adivce. please help

1) my father gave sale cum gpa with posession to person A and B. A and B almost sold all the plots and few are left.

2) recently my father and person B are expired.

3) Now person A is forcing us to sign the supplement agreement which states that legal heirs of B can sell the remaining plots along with A.

we want to understand

1) In this situation , who are owners of the plot. As legal heirs , can we claim the property.

GPA is just like an agency. it does not create any right , title, interest in the property. means person A and B has sold the plots on the behalf ur father and u r the owner of all remaining plots, which has not been sold.

What is the full form of GPA. General Power of Attorney. Its onlya a document which authorises the person/s named therein to do certain acts as authorised by the person who gave the GPA. Now that your father passed away, the GPA is not in force. As legal heirs, you are the owners. You may follow the procedure to get the plots transferred into your name.
