Grauity problem

Dear Sir/Madam

I, Manish Sharma, worked in private educational institute from 6th September 2002 to 27th july 2012 as a Assistant professor in private Engineering College.I have spent 09 years 10 months and 21 days as continous service without any gap.I requested to my institute for gratuity but they told me that "You did not complete 10 years of service".please tell me what to do in this case. i have already submit this matter before.but what actually i should do becoz i am working at another place now.how should i fill my application from other place?

Hello Sir,

As per my knowledge 5 years is the eligibility period to get gratuity.

Even though terms of employment doesnt provide for it , an employee is eligible for receipt if Gratuity if he has served continuous term of 4 yrs & 240 days in the fifth year.

Please refer provision for gratuity act.

10 years is the clause for being eligible for pension.
