Guidance required

Respected Sir,

       We gave a token advance of 2k for a flat(Rent was 14k).  Before 10 days to shift we went to see the house again. That time we saw that there was a big drainage infront of the house and the smell was horrible.Initially when we went to see the house the drainage was empty. Owner said due to some municipality work happening somewhere they have diverted drainage through this rain water drainage and it will be like this for 2 months.

 We were not able to even stand for 2 minutes in the parking. The flat is in 3rd floor and there was little smell also. After coming home we discussed with our parents and they were not agreeing for us to shift there because of the smell and we did not know definitely that it will be there was 2 months.

So we informed owner that we cannot shift and volunteered to pay 15 days rent. But he wants us to pay 20 days rent as damage charges. There is no agreement in writing between us. We have already given him 7k. He is calling and saying that he will come to working place with 3rd party. He even sent message like this to our mobile.

Please let me know what I should do.

Do you have any reciept/ note evidencing such a payment? If so, go ahead and file an FIR against them with following:

 

1. Photocopy of this reciept/ handwritten note

 

2. Take printout of these messages and produce them as proof of threatning .

Thank you for the reply sir. We do not have any written agreement.

Following are the questions I have

1. Is his demand valid?

2. I know I have dropped little late only because of the current state of the area and after vising again only I found out. Thats why I volunteered to give him 15 days rent.

3. I am little worried as if he visits my workplace things might get uglier.

See that's how they try to harass gentlemen. You did your part by offering him to pay 15 days rent. nobody can ever force you to do anything. you are living in a democratic nation man! why to live under fear? exert your right and don't be afraid, approach police. they will definitely help you. But atleast show them those messages as they rquire some proof to act upon.

i have taken an  flat in one of the building in pune around 400 sqft , one of the builder among three was my friend , i paid him by cheque the amount decided , and now flat is in my posssesion , but no document is yet done ( 10 yrs have passed ) since my friend had died after our deal within  1 yr . Other two builder are unnecessary asking for more money for getting sale deed done . amount  they are asking is more than what i have decided with builder and prevailing rate at that time . Now i am facing problem as there is no legal document yet only the corporation tax comes on my name since the  possesion and i am paying it regularly .

 

Now how should i resolve this matter , if any one can guide me.
