Harassment by wife

Hello Every one!

I am a victim of my wife. She has multiple boyfriends. Now I want to apply for Divorce in Court. However, I want to have some solid proofs before going to court. My question is whether the cell phone conversations made by her to her boyfriend’s stand as a proof of evidence?

Because now I want to try to get the cell phone conversation with the help of a spy camera system. Can I submit the text messages and cell phone conversations made by her? Will the court accept the way I followed to get the proofs?

Or the other way is to take the help of a spy camera to record her extra marital affairs. Whether this video footage stand as an evidence?

Please advice.

But the query maker can collect evidence on his own even he has enough as he is telling then why investigation agencies?and these evidences come under electronic mode acceptable under evidence act and information techonolgy act

Simply because your wife has number of boy friends does not constitute any offense that can be any help to you to file Divorce unless there is proof of cohabitation and intercourse..

A boy having number of girl friends and girl having number of boy friends are very common these days, this will not attract the penal provisions for adultery unless the extra marital relationship is proved. Having a friend of either s*x is not an offence.

All electronics evidence are admissible in the eyes of law, but you need to put a supporting affidavit of U/S 65B of Indian Evidence Act. This usually called as a 65B certificate.
