Dear members namaskar !!
We are a state Govt. office, a science centre, the contractor providing outsourcing manpower is claiming labour welfare fund (as per Haryana Labour welfare fund board) as per which contractor has to claim Rs. 10/- from the employee and Rs. 20/- from the dept.(us) for each employee and submit with the Haryana state labour dept.on montlhy basis.
The website of the Labour dept. states that " under secction 9-A (of Punjab Labour Welfare Fund Act 1965) this provision of the rate of contribution is for the employees working in the Industrial Estb. of Haryana state". A screenshot of the website is also attached with this post for perusal please. Now my question is :
Question no:1 : We are science centre where people visit by buying entry tickets to watch science show like a theatre and for science education. Are we covered under an "Industrial Establishment" or not ?
Question No:2 : Contractor has provided a proof of submission of said fund showing consolidated amount (the amount he submitted for all his ongoing contracts at various locations). If this Act is applicable on us, then How can we ensure that he submits us the proof in respect of the amount clamied for our contract?
