Help reqd: divorce filing,ab and councilling for elder broth

Sirs,

Pl.suggest:

1.Should we file Divorce petition WITHOUT Attending the councilling meeting.or should we file divorce petition AFTER attending the first councilling meeting. Counciling is this week itself.

(Councilling is in SIL's hometown Kolkata, brother is in Mumbai)

2. What kind of questions are generally being asked at councilling meeting, my brother is simple , innocent type. What should be his approach or replies based on.

3. As usual after completing and executing all her legal proceedings secretly, my SIL has again started sending sweet emails to my brother for living together and about love etc. which are fake, since she is now living with her boyfriend.  She used the printout of such love messages, sms's etc. in past when she suddenly appeared in local police station with mean intentions of getting my brother and mom arrested which did not happen.

- What should my brother reply to such emails ? she is trying to show/ proof that it is my brother who has left her, whereas she is living with someone else seceretly.

Dear experts - Please share your suggestions because councilling date is in this week itself.

1. You have to decide whether you want to file it before or after counselling.

2. Counselling is an attempt to reconcile the differences between the spouses in order to save the marriage. Therefore, the questions asked therein would relate to the marital life of the couple.

3. It is certain that she is trying to build up a good case for herself. It is best not to reply to such e-mails.

Do watch out for the false cases that could be registered against your brother by her.

I want to avoid any -ve impact on my brother case (divorce petition), pl.suggest the best alternative.

your approach should be in right way. If you don't want to reconcile then clear your intention. No -ve impact of this.

Divorce petition will not have any negative impact. On the contrary it could lend some help in contesting a a false case which might be registered subsequently against him.
