I am one of the residents in Pune. Our building has some flats and shops both. In Aug 2018, the residents formed a society. Chairman of the society is a native of this area and he owns shop as well as flat there. For the first quarter (Aug- NOV 2018), he, along with other shopkeepers, didn't pay maintenance for shops. For this quarter ( Nov-Jan 2019), he did not pay maintenance for shop as well as his flat. Along with him, this time, there are other residents and shops, who did not pay maintenance. Meanwhile, managing committee decided to send notices to all the defaulters. Currently, the draft of the notices are pending with Secretary. But, secretary is not ready to send the notices (either he is afraid or he has joined hands with defaulters). We are asking and following up with secretary to send notices for so long. However, he is just ignoring it. Secretary also does not maintain the documents required as per the society law, No meeting records, ledgers etc. Society meeting invitation is sent on whatsapp.
How can we come out of this problem? Also, if notices are sent, what is the process for doing so. Does it carry the acknowledgement of receipt of the notice. I want to ensure that all the defaulters have received and acknowledged notice
