I have declared medically unfit

I have been selected for the of Assistant Manager (Finance) (Grade - E3) in Dedicated Freight Corridor Corporation of India Limited (A government of India Company).

As per advertisement for recruitment the candidate selected for Finance discipline was required to be medically fit as per C-1 standard as prescribed by Railway Board. As per C-1 standard candidate should have Distance Vision: 6/12, 6/18 with or without glasses. Near Vision: Sn: 0.6, 0.6 with or without glasses.

However railway's medical norms also prescribes 

For non-gazetted services "There is no bar to the admission into non-gazetted clerical service of a candidate who is blind in one eye. The guiding consideration in such cases should be whether the candidate's vision is adequate for the performance of the duties attached to the service or the post to which he/ she is proposed to be appointed, and whether undue risk attaches in his being accepted. The medical officer while examining such cases should take into account the cause of blindness in relation to it's possible effects on the sound eye in course of time."

 

 

For gazetted services "One eyed person:- For all technical services, all posts in the medical department, all posts in Railway protection force, and Chemists and Metallurgists, one eyed persons should be considered unfit. These will include cases where there may be normal vision in one eye but the other eye is amblyopic or has subnormal vision resulting in lack of stereoscopic vision. However for employment in other categories the medical board may recommend such one eyed persons provided that it is satisfied that he/she can perform all the functions of the particular job for which he/she is a candidate, provided further that the visual acuity in the functioning eye is 6/6 for distant vision, and J.I for near vision with or without glasses, provided error in any meridian is not more than 4.D for distant vision., and normal color vision where ever required."

As I am one eyed person, DFCCIL has declared me medically unfit for said post and issued a letter informing that I have been declared medically unfit for C-1 catagory & I may appeal within 21 days for remedical if I submit a certificate of eye specialist indicating that findingd during first medical fitness test are not correct. As finding in first medical test that I am one eyed person correct, I can't apply for appeal. Please advise me whether I can do anyting (including legal action) in this behalf.

You may challange the decision in the court for wrongfully debaring you to the particular post for which the standard are not applicable. You may also approach to senior officers for reconsidration of the decision mentioning full situation that the standards are wrongfully interpretated in your case. In court you may have to wait till decision while in departmental request the decision is fast but having rather poor chances of success.
