S. SRINIVASA RAO (Retired)     17 March 2019

If a writ petition after final arguments dismissed

IF A WRIT PETITION IS DISMISSED BY A SINGLE JUDGE IN HIGH COURT AFTER FINAL ARGUMENTS, WHETHER THE PETITIONER CAN DIRECTLY APPEAL IN SUPREME COURT?

1.There are conflicting opinions that If a Single Judge dismisses the case, one has to file an appeal to the Div. Bench in the same High Court.

2. Another school of thought is that the Petitioner can straight-away file an Appeal in Hon. Supreme Court and there will be no objection.

Which of the above opinions is right and which is wrong may kindly be spelt-out.

Hello Sir,

In my view, one has to file an appeal to the Div. Bench in the same High Court.
