Illegal construction by my uncle violating the deed

sir,
I have received a property from my grandfather by a proper deed which was made by my grandfather and which was purchased by my grandfather. It is a two storied building consisting of 3 room in each floor. My grandfather give us two room in ground floor and 1room in 1st floor it's look like L. whereas my uncle receive it like inverted L i.e. one room in ground floor and two room in 1st floor. The deed clearly says if any one wants to construct2nd floor then the two room in 2nd floor will be us. but my uncle constructing two room in 2nd floor forcefully by violating the deed. please guide me what will I do now.

Sir, suppose if stay order imposed on that construction what will be the next step for me. And if my uncle file a suit what called partition case etc. and the deed is clearly mentioned about my right to construction can I easily win in this matter.
