Hi,
I would like to get advice & suggestion what can be done in the case .
I a society where a society office already in existence .
1) The chairman & secretary have builded a construction of almost 30 foot by 10 foot , height 10 foot aprox but what has happened here is they have not taken any permission from BMC BPD for the said construction.
2) The managing committee has also not shown the said cost of construction in the AGM / BALANCE SHEET of the society towards expenses or something etc.
3) Now the said construction is builded and ready and kept just like that or may the chairman or secretary using it for their personal use god only knows what they are doing with the builded construction .
4) What can a member of the society who is being harassed by the said chairman and secretary do against the rouge MC ?
5) Which laws and act of India / Mumbai can be made applicable here ?
6) Also the said MC has not filed M20 as the AGM was inly being held before august 2012.
7) Also the MC is not being elected by election and only on the basis of its wish & rule & power election is done on papers and circulated post resuming the office of the MC of the society .
8) Many times the details of the records of financial , working , etc has been demanded by members U/S 32(1) & (2) but its not been provided and replied to the letters sended to the secretary and chairman .
9) Excess transfer fees demanded / received in cash more than 200000 for each transfer in cash .
10) Conveyance done by the said chairman / secretary / MC but without providing conveyance copy and without providing details of EXPENSES & CONTRIBUTION BY MEMBERS.
11) False allegation are made in AGM by the MC against the members making complaints and harassed daily for the complaints being made.
Please advise what can be done in all aspects .
