Dear Ratnesh,
The transfer should be in connection with better utilization of his skills / Business requirement / in filling the skill gap etc and it should not be a victimization.
In case the employee is spoiling the discipline and part of punishment then you need to follow the disciplinery proceeding and as a punishment you can transfer. If you transfer with out fulfilling the required procedure then he may approach the Labour department and create an issue.
