I am fighting a case in District consumer court against builder who has applied illogical penalty on me.This case is continue since last 1 Yrs and is progressing. case is to waveoff this illogical penalty. Now builder has start giving possession of society flats, and i also wants to take possession. I will take it after paying penalty under protest.
But what will happen to my current case.. I want same case to continue and fight to take excess paid penalty from court. How this can happen, after paying under protest seems (not sure) my current case will become void. If i start a new case then again it will start from begning and will take time in processing.
Please suggest how same case will continue to take back excess paid amount, what is required for that..
