Interim maintenance guidance required

Respected reader,

Wife earning more than husband, still the interim maintenance & legal expenses are granted in RCR filed by husband, Husband wants to go for suspension against the interim maintenance in High court.

 

During the case period in high court, is husband required to pay maintenance and legal expenses?

Can the defense be struck off if maintenance not paid?

Please share any relevant citation for defending in this case.i.e. non payment of maintenance.

Ask your lawyer for all the citations and case laws for your help, it's his legal duty for which he's being paid, this free consultation forum no one had so much time to work out the case for you and that too free of cost.

In case HC does not grant stay order, let the trial court dismiss your case after winning the appeal HC will order to reopen the case. But same will backfire if you lost the appeal and because after that your wife will file the case of execution.
