A DV Act petition is dismissed by the Magistrate. Can the petitioner pray for an interim order restraining the resp. from disposing prop. along with appeal. Can the appelate Court pass an interim exparte order.

All DV act accused must fight at the start to get the complaint dismissed. Once order is passed very hard to get it amended or revoked.

DV petitioner will not get the the interim restraining order against the respondent except on the shared household as she would be entitled to a right to residence. That too in certain cases only.
