Ipc 419

Hello Sir,

My wife has filed a FIR U/S 417,419 nad IT act 66C and 66D. Iam A govt servant still under probation and i have already 498a and Domestic Voilenace case running in courts.Durimg the trial of Domestic voilence case, i have submitted a printout of marriage profie of her available on net along with headrers and footers i the court which dislosed her income. After 8 months now my wife has filed another FIR alleging that she suspects me or somebody on my instance has created her profile. A copy of the FIR has been submitted in the DV court by opposite lawyer.

Now my worry is should I apply for bail as 419 is a cognizable offence ? As of I know i have not recieved any summons and being a govt employee should i inform my office about it or wait till summons/notice is issued to me ?

Please advice me on this matter.

TGK REDDI@ Sir, The DV case, 498a and fresh FIR are in in different courts. Please elaborate why I cannot apply for bail in a trial court as it is different court. Also elaborate on why i should shy away from court for a complaint simply based on supicsion and prejudice.

TGK REDDI@ Sir, " You cant stand before the presiding officer ". Is it the presiding officer of the court where the fresh FIR belongs ? Or the Presiding officer of the DV and family court or the presiding officer of the 498a court or any presiding officer.?

TGK REDDI@ I will be thankful to you if you can give a conclusive reply which doesnt lead to anither question. Do you mean, "Presiding Officer of any Court that hasn't issued process yet" that i can put up my case in DV court as the new FIR will tried in another court ?n Or do you mean stay that fundamnertal rights are infringed just beacuse a FIR is filed and i havent received the summins yet ? What is the time frame to issue summons once FIR is issued? Please elaborate on why I need Anticipitory bail when i have the option of surrendering to police its a baiable scetion ?

TGK REDDI @ Sir thank you very much for your kind reply. Sir please clarify one more doubt, whether police can arrest me arbitarily wihtout warrant since IPC 419 is a cognizable offence. The status of thcase is being shown as ,"under investigation for documentary evidence".Since the FIR has been lodged should I informm the office as Im a govt servant or should i wait till the CrPC 41 notice or summons are served ?
