A builder dishonestly sold a land to Mr. Anish, I mean he showed a land and register some other land, and keep avoiding for possession, when Mr. Anish came to know about the fraud he made a complaint in Police and the builder got arrested in July-2014 and got released on bail after 2 months.

The fact was, after arrest the builder paid 10 lakh to Mr. Anish by cash and where Anish had paid him 8 Lakh fori the land, in 2011 and now that property cost is almost 30 lakhs.

In the High Court Advocate of Mr. Anish argued that the properly cost is triple of the amount what builder paid to Mr. Anish, hence he should pay  as per market value to Mr. Anish register the original land to him.

But without considering this, the High Court pass the order and allow the bail, with certain condition that builder shall not contact to Mr. Anish in any manner and also take 5 lakh bail bond, of two.

The case which was before SDJM still pending, Police has not submitted the charge sheet yet.

Since then there is no communication between them, my question is how Mr. Anish will get his orginal land or the value of his property.

Now the builder said that he has already paid the amount to Mr. Anish,

Where the land is still in Mr. Aanis’s name, and the builder is not demanding that also.

Can Mr. Anish Sold that land to someone………..or he cannot sell that land until the case is pending.

What Mr. Anish Shall do now…………
