Is a legal agreement necessary for a consulting contract

Hello..

I'm a Restaurant consultant and I would like to know whether a legal agreement is required (in stamp paper) for getting into a contract with a client or just getting a signature from the client on the proposal with rubber stamp (in letter head) will be enough.. some clients also give their confirmation through emails. Most of the time the agreement value falls between 50K to 1Lakh. Thank you!

Just remember, legal agreement upon Stamp Paper is considered to be best evidence for the fact for which agreement is made. If you want to be protected in eye of law then go for legal agreement in a stamp paper. Also remember before the Court, it is best evidence than that of hand written or any other things.

Make your agreement on stamp paper and get it notarized by the notary advocate , he will enter your details in the register with him and take sign of both the parties it has evidentry value before the court .

Under the Contract Act no where its provided that in order to be valid contract it has to be written and that too on Non-judicial stamp paper. You can for the sake of record make simple agreement on plan paper which both parties sign and keep with them a copy each of this duly written and signed contract with them. No further formalities required.

Agreement is the best option but you can also take work order on the clients's letter head containing all details of you work, fee, tenure etc. Containing your acceptance also. Such document also form agreement.
