Is it legal to extend a flat by using the flower beds ?

Are you allowed to extend your flat by using the flower beds ?

 

One of the members in my Society in Mumbai has used all the flower beds and has extended his flat all the way till the windows. You can't make out from outside, but from inside his flat you can easily see this alteration. Is this legal ? Even after complaining to the society, no action has been taken.

 

Should I complain to the BMC ? Also is it possible that the BMC would consider giving permission for the flower beds to be used into the flats ?

Is the extension causing you some problem?.As per my knowledge the area/structure should be same with that of the drawing shown for municipality permission.

but I would like to request you not to spoil the flower beds.

Thanks for repyling. But since this extension results in increase of floor area/carpert area, shouldn't there be stamp duty or some charge for it ?

Also even if it does or doesn't affect anyone, it is still illegal and i think the owner and his architect should be taken to task.
