I am planing to buy a flat in Bangalore. The building is under constuction and i have a choice to buy it directly either from builder or land owner. Builder is charging Service tax + VAT however land owner is saying that he will not charge any service tax or vat if I buy it from him. The reason he is saying that the builder is liable to pay service tax however land owner isn't. Please advice if this is a legal practice or he is misguiding me. Will i get charged (service tax+vat ) at the time of registration if land owner is not charging me right now. I am planing to book it in Feb 2011and will get a possession in Jan 2012.
