Hi, Plz help me for this scenario. Deceased died by falling from under construction power grid corp' tower located at Vishkhapattnam rural on 5 Jan 2016. He was working under a sub contractor (PNS, purnia, Bihar) who works for the contractor company "iXX pvt ltd." hyderabad. and iXX works for power grid corp. deceased "Prakash" is resident of Munger,Bihar. PNS brought the dead body to deceased's village after autopsy and paid only rs.10,000/- to his father promising 8L of compensation. But untill date he is skipping and escaped. We want to file the case for damage and compensation for the same. We are confused that whether jurisdition for the same is only at Vishkhapattnam district court or the home district (court of dist judge) of deseased also is permitted. Another point to noted is according to educational certificate the age of the deseased was only 17.3 yr at the time of death, whereas all police document(fir, pm report, dead body delivery challan) shows as 21yr. If we can take any advantage of this(under age factor) while drafting the case...?
