Thanks for your reply.

I am working in the KPO from the last approx. 2 years and on 12 Aug they verbally informed us that start searching your options for the job as our two major clients have gone and all the employees can consider this statements as information, memo, warning, or any other thing. And on the very next day, 13 Aug, they said that now there is no need to search job as the company is talking to the client and will have the work soon. On 26 Aug, the company put a notice on back date (12 Aug) stating that "the whole month is a notice period," and there was no authorized signature, which we all know is invalid. Then, we contacted the Noida labor office but did not lodged any complaint and after that they agreed to give us salary til the date 12 September which is invalid. We all employees lodged the complaint on 28 Aug and the labor inspector came to our office on 29 Aug and asked about various documentation from our HR manager from which it has been proved that they are fraud and running the company illegally. I would like to tell you one more thing that the company is US based and the owner is an US citizen and they do not have any branch all over India. Please guide us about all this, what are our rights and how we can have rights (please mention the act also as we do not have any knowledge).

You said. Labour inspector visited your work place.He enquire and submit a report to the labour commissioner. He will look after about your complaint. Just get in touch with his office. If you are agrieved persons, the case will be booked. or else he will settle the matter. Obtain your grievance copy with acknowledgement from the labour commissioner.

Lodge a complaint in writing and demand certified copy of the report submitted by labor Inspector even if thru RTI and press the ALC/DLC/ Labor Commissioner to charge the manager/owner as declared in  registration  form submitted under Uttar Pradesh Shops and Commercial Establishments Act (U.P. Dookan aur Vanijya Adhishthan Adhiniyam, 1962)……………………………….

If you suspect any lacklusture approach by Labor office submit escalation to higher officials under proper acknowledgment.

In case everything is illegal get the manager arrested by police and don’t leave police station till the time your wages till date…………………. months’ notice pay (claim retrenchment compensation @ 15 days/year ), PF dues,ESIC etc everything is paid………………………………

Lodge complaint against employer (US Citizen) and involve Ministry Of Overseas Affairs ……………………………..Labor etc…………..

All employees may unite hands and stand as witness to each other and can approach;

 

---Employee’s unions,

---Trade unions e.g. CITU,AITUC, INTUC, BMS,………..

---Inspector under :U .P. Dookan aur Vanijya Adhishthan Adhiniyam, 1962, Payment of wages Act

( The labor Inspector in local o/o Labor Commissioner might also be functioning as

Inspector under :U .P. Dookan aur Vanijya Adhishthan Adhiniyam, 1962, Payment of wages Act, however lodge separate complaints under all acts…………………under proper acknowledgment.)

---Labor Consultant/Service lawyer………………………Yourl lawyer may opine that you can file complaint u/s 406,420 also……………….
