We have booked plot at jaipur and with a local developer . the commitment was to deliver the plot in 3 months from the date of booking ie sep 2014 and for booking 25 % of total amount and rest 75 % after approval of project by govt at the time of registry .
BOOKING AMOUNT WAS PAID BY CHEQUE AND NO RECEIPT HAS BEEN GIVEN BY DEVELOPER TILL NOW....
But it is almost 1 year have passed he is not able to get the project approval from govt authority due to some legal point at his end......but saying that it will be done in due course of time without any time commitment by developer.....
what should be course of action in following cases ;
1) for refund ------the developer is giving refund ie 25 % full amount without addition or deduction of amount paid ..........
QUERY : can we ask for compensation of amount as due to his fault he is not able to get the approval and he has used almost amount for 1 year.
2) COMPANY PROMOTERS ARE NOT FACING ANY CLIENTS .....
query : what could be legal action for this situation ....
Only staff taking refund request on Rs 10 non judicial stamp paper for withdrawal by booking holders.
3) what and how the compensation portion to be work out ?
