Landlord not accepting rent

Hello 

My father took shop under goodwill from owner in 1982 landlord passed away in 2005

My father passed away on 15/04 this yr , my father has agreement with Landlord , Now i have sub let the shop to my relative without any agreement from past 10 yrs , legal heir ie son is not accepting rent from May & june as he came to know my father passed away & he has good chance of me to vacate as we are paying old rent of 2500 now neighbouring shop pay 12000 to 15000

he has become greedy - i have agreed to double the rent - they have not accepted rent 

how do i deposit rent ? what legal actions can he take ? if they want to do out of court settlement can i ask compensation & i will vacate .

I t will depend on your state rent act so pl tell which city the shop is loaclted.

Long possession and payment of a uniform rent are not  sufficient to prove a permanent tenancy.Where a notice to quit or pay enhanced rent is issued to a tenant, if the tenant refuses to quit, he must be deemed to have ageed to pay the enhanced rent provided it is not penal or exorbitant.

You have to deposit rent in Court to avoid eviction on the ground of non-payment of rent. You have to wait and watch the next move of the owner's son. Your claim is weak. You cannot ask for compensation right away. the question of compensation always arises when the tenant has harassed the landlord to a great extent and the landlord is fed up of him and agrees to give him compensation and vacates him. In your case, still the legal battle has to ensue...

my landlord has given time fr 3 months , bt my relative is not ready to vacate shop

i dont have aggreement with him as i have sub let
