Leave and license agreement (poa)

Dear members,


the following query may please be treated as urgent.

I own a flat in joint ownership with my wife at Navi Mumbai (Kharghar). I am planning to give it on Leave and license to a family. I have made an agreement for the same and will register it soon. I understand that due to flat being in joint name, myself and my wife have to go to sub-registrar's office for L&L registration. But due to certain personal reasons she is unable to go for registration. Now my query is:

(i) Whether, I alone can register the agreement?

(ii) Can I have a Power of Attorney for the same from my wife authorising me to go ahead with L&L?

(iii) Should this POA need to be registered or notarising will be sufficient?

(iv) If POA registration is must whether it has to be done with sub-registrar at Panvel (where property L&L agreement will be registered) or it can be registered at Mumbai (chembur area) also?

Please provide me with legal way so that i do not come back from office of registrar without the work..

If possible please provide a sample of POA and value of stamp paper.

you alone cannot register the document.  so your wife may give you POA.  the POA may be registered at chembur area on stamp worth Rs.100/-.

2) Yes;

3) The POA should be registered;
