Legal heir certificate

Dear Friends My mother had an demat account ( with no nomination) and she died inter state. Her demat account was closed after seven months of her death under normal closure and not under decesed closure. We have raised and submitted application with Bank and Police as well. But Bank is asking for Legal heir certificate. Suggest how we can proceed in the case.

If the head or a member of the family passes away, the next direct legal heir of the deceased such as the wife or husband or son or daughter or mother may apply forSuccession Certificate on application for the purpose of transferring Electricity connection, House Tax, Telephone connection/Patta transfer, Bank Account, etc. Approach a lawyer. He will guide you.

Is it so that for all movable properties you need to have succession certificate and for immovable legal heir certificate will do.

And also legal heir certificate will be sufficient for gathering information from Banks regarding her account.

Legal heir certificate is usually issued by O/o Tehsildar after inquiry by revenue officials e.g; Kanungo, Patwaari.
