Legal heirs rights

This is a very typical case of legal heir of hindu family and their rights. Consider that there are 3 legal heirs (brothers) for a property, after expiry of the parents. Property is earned by parents and is not ancestral. And as usual off-course there is no deed by any of the parents. Is it possible to sell the parents property by any one heir, on the basis of nomination in co-operative society, without knowledge of the other two heirs ? If yes how can all the legal heirs protect their own share in their parents property ?

No, You all need to file for Letter of Administration and Succession Certificate and get the property and securities of your parents in your joint names. One cannot sell it without being given rights by the other heirs.

To sell the property one needs consent. Please get basic informtion regarding the current status of your property and also check if there is any petition filed in court. Also, look into your districts collectors office for more information.
