Get married under the Special Marriage Act,1954 by the Marriage Officer of your district where you live. The marriage officer is usually the Deputy Commissioner of the district, contact his office for required details for documents and procedure.
Proof of age, address, marital status of both parties will be required and for foreigner a NOC from her Embassy in India for getting married in India with an Indian.
This will be purely Civil marriage so no issue of change of religion of either party required nor any objections with regards to nationality.
Yes both parties should be unmarried or divorcee or widow/widower as the case maybe.
The marriage is solemnized after one month of notice for marriage hence the foreigner should be present in India for more than one month, no waving of one month notice period allowed by any authority.
