List of witnesses....for crossexamination

Respected all,

Can the application for making submission by  the opposite party (wife) be allowed by the court for any more witnesses to be cross*xamined when the case is fixed for arguments by the judge??

What is correct technically in law?

Please clarify.

If the application is frivolous to prolong litigation and harass the opposite party, it will be dismissed.  If it is to produce important witness to prove vital fact, it will be allowed with costs.

thanks a lot.....

sir the court has cleared its mind that the case has been delayed a lot pending since 2008 and now at the argument stage wife submits to get another witness cross*xamined but its on order that she earlier stated   1 1/2 years back that only she will be examined and there is no other witness other than her.

I fully agree with Adv.Prabhakar, but in reality it is better to accede the request, and carry on with the case even though the case is delayed  and prolonged.

Or sir , it could be left at the discretion of the Court itself to decide.
