Loan repayment

sir,

Iam Nalini.R i have given Rs.40,000/- through neft bank transfer to Mr. Rajappa in 2014.

till now he has not repaid back and he is not reciving my calls what is precedure to send notice.

Kindly advice me.

1. YOU MAY SEND A LEGAL NOTICE BY SPEED POST A.D./ REGISTERED POST A.D. TO THE SAID PERSON WHO IS BORROWER. YOU MAY MENTION ALL FACTS FROM THE DATE OF SAID FINANCIAL TRANSACTION AND ALSO MENTION ABOUT RECEIPT OR ACKNOLEDGEMENT OF LOAN /AGREEMENT IF ANY. YOU MAY DEMAND BACK SAID AMOUNT MENTIONING A NOTICE PERIOD OF TWO WEEKS AND IF REPAYMENT IS NOT MADE YOU MAY FILE A CIVIL SUIT IN COURT OF CIVIL JUDGE SR. DIVN FOR RECOVERY OF SAID AMOUNT. KINDLY FURTHER NOTE THAT IN CASE YOU HAVE TAKEN ANY CHEQUE IN REPAYMENT OF SAID AMOUNT YOU MAY DEPOSIT THE SAME IN YOUR BANK AND IF DISHONOURED YOU MAY  ISSUE NOTICE UNDER SEC. 138 OF N.I. ACT AND AFTER NOTICE PERIOD OVER YOU MAY FILE A CASE UNDER SEC. 138 OF NEGOTIABLE INSTRUMENTS ACT ALSO.
