Lok adalat - Settlement - Court fee refund

When a matter is settled out of the court. Then, How much court fee will be refunded?

Have you withdrawn suit  from the competent Court ?

What is your Advocate's opinion on such refund ?

No Sir. Am a law student. Yesterday i saw one advocate arguing for this issue. I guess he filed a settlement memo.

If you are a student, search in google  Sec.21 Award of Lok Adalat, The legal services Authorities Act, 1987 which states as under

"In a case referred to it under Sub-Section (1) of Section 20, the court fee paid in such cases shall be refunded in the manner provided under the Court Fees Act, 1870 (7) of 7 1870.

That means what ever court fee was paid earlier by plaintiff, can be refunded.

Most of the time court refunds 2/3rd amount court fees paid. If matter was on ripe stage of trial may be it may refund 1/2 or 1/3 rd amount paid. You get the correct amount when you get the drawn up decree in your hand as after that you can get refund from collector/supritendent of stamps
