Madras HC issues notice to BCI and BCT

 

The Madras High Court today issued notice to Bar Council of India and Bar Council of Tamil Nadu on a petition seeking quashing of resolution passed by the latter in conduct of the election of its members and office bearers and to appoint a special committee to administer BCT.

G Rajendran, an advocate submitted that the tenure of Bar Council of Tamil and its members expired on October 12 2010.

Available records indicated BCT has become 'non-existent' from that date, he said, adding BCI has not extended tenure of BCT members before the expiry date.

He contended that all acts and other businesses by BCT after that date were invalid and illegal since BCT had not obtained any extension.

Rajendran said only BCI and not BCT has power under any provision of law to hand over administration of the Bar Council to the Advocate General.
