Maharashtra Co-Op. Societies Act

Hi,

Can anyone advice me as to whether a registered CHS can recovery outstanding dues and maintainance from a non-members of the society and under what provision. What is the procedure for receovery of outstanding dues from a non-member of the society.

1.  CHS is meant to a ghetto of its own members. By this logic,  CHS has no jurisdiction to recover any type of charges from non-members.  There is simply no provision under the Cooperatives Act.

 

2.  In Maharashtra under the MCS Act, the CHS may inititate recovery proceedings u/s 101 of the MCS Act to recover legitimate outstanding dues ONLY FROM ITS OWN REGISTERED MEMBERS, subject to a host of paramters and procedures.
