Hi,

 

I have a flat in a reistered society (say soc A)

 

I now want to buy a 2nd flat in another/seperate registered society (say soc B), both soc A & B are within the same compund and have same city servey number, but are seperately registered. (It's in Mumbai - Chembur)

 

I want to buy this 2nd flat in my wifes name, from her independent source of income.

 

I don't intent to sell my 1st flat.

 

However Society B is objecting to the proposed purchase, citing - A single family cannot have 2 flats in 2 different registered society within the same compund and having same city servey number.

 

I have 2 question : (1) Is society B's stand correct. (2) If society B is wrong, how should i legally convience them.

 

Your opinion will be of great help, as i desperately need this 2nd flat for my aging parents.

There is no such restriction. Person is entitled to buy another flat even in the same building.

It is not for you to prove but it is for the society which is objecting the proposed purchase to supply you with the relevant material on the basis of which they are taking a decision.
