maintainence procedure???

my wife has filed case for demanding maintenence since one yr. but i have not attend the summons yet.  plz answer followings. 

a) is it right that husband has to give 1/3 of his income. ????

b) i am not giving any income tax  will it help me??

c) i have few property on my name can wife claim for her share?????????

A--IT IS APLLIED IN ENGLISH COURTS BUT ACCORDING TO THE INDIAN COURT IT CAN BE LOWER OR HIGHER DEPENDING UPON THE CIRCUMSTANCES LIKE EARING OF BOTH PARTIES , MEMEBERS ETC

 b) i am not giving any income tax will it help me??

A-IT DEPENDS CASE TO CASE OTHERWISE NO(WHAT I THINK THIS IS ONLY TO PROVE YOUR SALARY,INCOME AS CASE MAY BE  )

IF YOU ARE AVODING SUMMOING OF THE COURT  A PROCLAMATION BE DONE BY THE COURT AND EX PARTY ORDER   CAN B PASSED AGAINST YOU AFTER THAT .AND IF YOU R DRAWING YOUR SALARY  THROGH BANK YOUR BANK  ACCOUNT CAN BE FREEZED OR PROPERTY CAN BE ATTACHED . SO TAKE YOUR ACTION THROUGH LAWYER
