maintenance after RCR for earning women

Dear Experts, I wan to know whether maintenance will be given for under cruelty and Desertion cases also? My RCR case is in CE stage. She only not join me aftet lots of counselings conducted from elders till mediation level. Once I get RCR order I am thinking to file DIVORCE. apart from that when I went to see my child her family members beaten me. I have vedio record of all these. She also earns lot with her Master degree in IT industry. If I file divorce is she qualified for maintainance? If so and if she earns half of my salary , what would be the % she may get. I am sure that she will not marry in future. Please reply me thanks

if she is a qualified lady and earning a handsome salary , prove it in the court and oppose her maintenance petition ,if court satisfied then court will not grant her any maintenance but as far as your child you both husband and wife are liable for his maintenance you have to give your share as decided by the court .

On the basis of the evidences to prove that she is properly employed with some organisation and she is earning a handsome salary, her maintenance case can be challenged and she maybe declined with her claim. But you will be liable to pay maintenance to your child.

Thanks for your reply. It is not clear that even if she gets handsome salary and I am able to prove the same, some women I saw in court says husband salary and status is more so they need maintainance? How far this argument is considered by court and are the working good salaried women not at all eligible for maintenance? I am happy to give maintanance to my child.
