Maintenance charges increased by builder

Hi, I have bought a flat in Pune and for the last 2 years I have been paying the maintenance on Rs. 1.5 psf. Now builder is asking for increased maintenance of 2.5 instead of 1.5. Can builder increase the maintenance amount? Can he do this without forming the society? Regards, Vicky

Yeah basing on terms and conditions, it depends. Maintenance is variable component basing on incurred charges for maintenance of.building.

Sir,

It depends whether the society has been formed and registered, in which case the builder has to execute a conveyance in the favour of the society and the society would then collect the maintenance as per the Bye-Laws. If, however, a society is not formed or registered then the builder can charge reasonable legal maintenace, however you can ask for the break-up of the maintenance charges and its legitimacy.
