Dear,

I am in Managerial Position and have not received salary for last 03 months, what course of legal action recommended by your good-self towards the employer.

Have you been supplied with salary slip?

 

Is the salary processed but not paid?

Are the stautory dues like TDS,PF,ESIC etc paid?

Why the salry is not paid?

 

The earned wages have to be paid on fixed day/date or employer can be penalized /instance.

You may stil be converede by enactments e.g. Payment of Wages Act, Shops & Estbs Act.

Even otherwise you can lodge complaint in writing under proper acknowledgment with good offices of appointing authority,MD, Chairman and demand to supply salary slips, quaterly filed tax details,saalry.......................say within next 3 days and explain that you are facing unmanageable financial hardships..................

The employer that does not pay salary on fixed/promised day is unworthy of being employed with. In scuh situation the T&C like notice period/pay etc may loose its sanctity.

 

Firm up your next venture ASAP.

You may show all docs on record to ana ble counsel specializing in labor-service matters, and your counsel may opine that you can lodge complaint u/s 406/420, winding up petition,approach civil court for recovery etc...........
