Marital Rape law in India needs change

 

Introduction
The idea of the “sacrosanct” institution of marriage dished out by the mainstream Indian cinema is a myth and is contrary to women’s perceptions of reality. Though marital rape is the most common and repugnant form of masochism in Indian society, it is hidden behind the iron curtain of marriage. Social practices and legal codes in India mutually enforce the denial of women’s s*xual agency and bodily integrity, which lie at the heart of women’s human rights. Rape is rape. Be it stranger rape, date rape or marital rape. The law does not treat marital rape as a crime. Even if it does, the issue of penalty remains lost in a cloud of legal uncertainty. The legal system must be forced to accept rape within marriage as a crime. Further, women themselves must break free of societal shackles and fight for justice. They must refuse to comply with the standards applied to them as the weaker s*x. This paper is an attempt to expose the discrimination, shortcomings and fallacies of the criminal justice system in India as regards marital rape. It goes on to provide arguments and reasons necessitating criminalization of marital rape. Lastly, the paper suggests certain legal reforms essential to achieve the desired objectives.

How “sacrosanct” is Marriage in India first that has to be dished out and removed from vocabulary of Legislatures r/w ld. Judges. Today mere drop of hat spouse wants their empowerment (freedom). Just read last 10 queries in Family law forum and see date of marriage and feel the pain of the queriest be it male / female and what they ask for their freedom from other spouse. If marital rape is legislated it would be one masterstroke for all metro wife to get instant relief.

 

Also yes I do agree marital rape should be included but my opinion is that it should be included in Bharat Ratna DV Act and not under CrPC or IPC by way of Amendment 2012. Anyhow Bharat Ratna DV Act in just 2 days time will complete 6 years of giving "solid dreams" to metro females so it is about time WCD / Law Commission of India start working on "white paper" on Amendment of DV The Act to include “marital dream rape” in Dream Violence Act Amendment 2012. 

Today it is on record said by women sensitive advocates that it is difficult to bring evidence of what happened in 4 walls of a bedroom. I wonder will same get extension in "marital rape" evidences cases, obviously yes and thus fine tweaking petition writer’s template skills cometh on board for lacs of metro wives rescue!

Gone are queries from face of Family Law forum say from metro wife; suno ji my husband is crorepati he will fudge with potency test what shall I do vis-à-vis naïve husband query; bahisahib thank you, you all are doing gr8 service replying to queries but meri eik problem hai, I did my potency test it came out OK should I do it again if wife alleges and court allows and what if it does not come OK this time and pls. pls. pls. tell me which all tests I have to do.
I mean in one masterstroke you are making impotency allegations ultra-vires just like RCR

I however welcome inclusion of "marital rape" in which ever form it comes on board. Let there be more twists and turns in our marriage from FIRST NIGHT.

On first night of our marriage he raped me and my In Laws were standing outside our bedroom door.
Result of such masterstroke; Instant jail for husband who just finished his first badam milk shake and party persons i.e. In-laws.
How can anyone say no ji it will not be so donot be so harsh to such refreshing path breaking laws, let us wait for it to form legislation?
To them my question is simple; Has rape become un-bailable offence on mere statement of any lady (married/un-married) as of today!

Agree with Tajobsindia.After such IPC sec introduced it will increase intolerance among wives.After marriage is the licence to S*x  and much reliefe is already given to a woman in Indian Law.

They must refuse to comply with the standards applied to them as the weaker s*x. 

Than what for has the DV act being enacted it should be scraped first as women has been defined as the weaker s*x in this act . :(

How is rape  defined as of date 

 

A defendant, A, is guilty of rape if:

_ A intentionally penetrates the v**gina, anus or mouth of B (the complainant) with his penis;

_ B does not consent to the penetration; and,

_ A does not reasonably believe that B consents.

Rape shall  includes oral and anal penetration with a penis.The person who commits the offence of rape must be a man or or a women   However, both women and men may experience rape is it not a fact as of today . If the penetration is with something other than a penis then the offence is assault by penetration

For the offence of rape to have been committed the defendant must have penetrated you without your consent, or continued to penetrate you after you withdrew your consent, and the defendant must not have reasonably believed that you were consenting.

 If the defendant intentionally penetrates with his penis the v**gina, anus or mouth of the complainant without her consent where he does not reasonably believe in her consent the defendant has committed rape.

1. Now the next question debated would be what about same s*x marriages . 

2. Martial rape should include ( MEN V/s MEN , Women v/s WOmen ) same s*x marraiges by looking into the future also .

3. What about cases where women rape children ?? can that too be included as rape 

4. CRPC 125 should be Amended to include the word Who so ever fails to maintain or neglect the Husband wife and children .since as of today metro wifes too are earning . CRPC states only wife and children .
