Memorandum of settlement in 498a and divorce case

Learned Sir/Madam,

Kindly examine and put your valuable remarks on the strength and the legality of the following draft of Memorandum of Settlement to be filed in a Divorce and 498A case.

 

BEFORE THE HON’BLE PRINCIPAL JUDGE, FAMILY COURT, XXXXX City

Mat. Civil Suit No. 111/11111 (Divorce)

IN THE MATTER OF

Versus

MEMORANDUM  OF SETTLEMENT

In accordance with the counselling session conducted by the Hon’ble Principal Judge, Family Court, City, the following Memorandum of Settlement is hereby accorded between the parties of the Mat. Suit No. 109/2010 U/s 13 of the Hindus Marriage Act, 1955.

The terms of the MOS is as follows :-

1. I, the wife, do hereby offer my sincerest unconditional apology to my husband  and my in-laws for filing counter-blast criminal cases in different courts viz, IPC 498A against petty skirmishes, thus, causing grave harm to their self-esteem, reputation and liberty.

2. It is to affirm that I was neither demanded nor tortured ever for any demand or what so ever.

3. Further, it is confirmed that my father Shri XXXXXX  shall compensate my husband Shri MMMMM with an amount of Rs. 1,50.000/- (Rupees One Lakh Fifty Thousand only) within a period of 01 (One) year signing this memorandum of settlement and receive a receipt on liquidation of the same from him on or before 21st June, 2015, against the undue legal expenses due to the criminal cases filed by me on his behest.

The aforecited paras from 1, 2 & 3 are spelt, sworn and submitted by me while being present in the pious premises of the Hon,ble Civil Court, CITY on the 111 Day of July, 2014 in my full consciousness and without any fear or doubt.
