My grandpa got a land in mortgage for a period of 5 yrs in 1944.
then he got permission to construct room for look after the property in 1946.
under which law it is permissible .
kindly provise some case law, supporting the view.
what are the mortgagee's right in case mortgagor is not able to release property in stipulated period.
suggest me................

1- Nature of Mortgage---- against money lended
2- Mortgage with Possession or with out Possession-----with posession
3- got Permisison to cosntrcut - Who permitted .....permission got from local municipality ( local govt.)
Actually my grandpa got this property. & now a land smuggler has eye on my land. he got allotment by urben improvement trust(UIT) saying that permission we got that time is not valid & mortgagee can't get permission in mortgage period.
