Mutual consent divorce

boy is u.s. citizen and girl is staying in India. Can they file mutual consent divorce in India through power of attorney as boy does not want to come to India

At the time of filing there is no need to present physically, the boy can file the suit by executing a VAKALATNAMA to the lawyer,but at he time of final hearing the boy has to appear physically before the Court.

It would depend on which state you are in?

 

Some HC have allowed it, some have not allowed it.

Should be allowed, it is allowed in Delhi Courts,

 

But infrastructure is not avaialble in all courts.
